1. Identification and Operator

GravityFlash is a commercial brand operated by Feebelt LLC, a registered company in New Mexico, United States.

GravityFlash is a SaaS platform that allows clients to manage and facilitate access to digital content hosted on external infrastructures (e.g., Amazon S3, Wasabi, or other storage providers).

GravityFlash acts mainly as an access and management layer over third-party storage infrastructures.

3. Payment Processing

Payments are processed securely through Stripe, acting as our payment gateway.

• GravityFlash (Feebelt LLC) acts as the direct seller and merchant of record for all transactions.
• Stripe processes payment details securely. Your credit card information is never stored on our servers.
• All billing, invoicing, and applicable taxes are issued and managed directly by Feebelt LLC.

4. User Account

To use the Service:

• The user must register and provide accurate information.
• Is responsible for maintaining the confidentiality of their credentials.
• Is responsible for all activity under their account.

5. Acceptable Use

The user agrees not to use the Service to:

• Distribute illegal content.
• Infringe third-party rights.
• Transmit malware or harmful content.
• Perform unauthorized access.

GravityFlash may suspend accounts that violate these conditions.

6. User Content

The user is solely responsible for the content managed through the Service.

GravityFlash:

• Does not review or control the content.
• Is not responsible for its legality.
• Does not assume responsibility for losses derived from the content.

7. Platform Intellectual Property

The software, design, interface, workflows, brand, logos, and technology associated with the Service are the property of Feebelt LLC and/or its licensors, and are protected by applicable intellectual property laws.

8. Service Availability and SLA

GravityFlash commits to making reasonable efforts to keep the Service operational. However, the specific technical conditions of the service, availability levels, maintenance, and support priorities are described and governed by our Service Level Agreement (SLA).

9. External Integrations

The Service depends on external providers (S3, Wasabi, etc.).

GravityFlash:

• Does not control said services.
• Is not responsible for failures in those infrastructures.

10. Limitation of Liability

• In no case shall GravityFlash be liable for loss of profits, business interruption, loss of reputation, or indirect damages.
• GravityFlash's maximum liability is limited to the amount paid by the customer in the last 3 months, as detailed in our SLA.

11. Termination

The user can cancel their account at any time.

GravityFlash may suspend or cancel accounts for:

• Violation of these terms.
• Misuse of the service.

12. Modifications

GravityFlash may modify these terms. Users will be notified when relevant.

13. Applicable Law

These terms shall be governed by the laws of the State of New Mexico, USA, without prejudice to any mandatory rights that may apply to consumers under their local applicable law.
